1. About Bookiora

Bookiora is an online marketplace that enables customers to discover, book, and attend experiences offered by independent hosts.

The Platform provides technology that facilitates:

• Experience listings.
• Online bookings.
• Secure payment processing.
• Booking fee collection.
• QR code generation and verification.
• Host and customer account management.

Unless expressly stated otherwise, Bookiora does not own, organize, operate, or deliver the experiences listed on the Platform. Each experience is provided solely by the independent host responsible for that listing.

2. Eligibility

To use Bookiora, you must:

• Be at least 15 years of age.
• Provide accurate and complete registration information.
• Comply with these Terms & Conditions.
• Use the Platform only for lawful purposes.

By creating an account, you represent that you satisfy these eligibility requirements.

3. User Accounts

Users are responsible for maintaining the confidentiality of their account credentials and for all activities carried out through their accounts.

You agree to:

• Keep your password secure.
• Use accurate and up-to-date account information.
• Notify Bookiora immediately if you suspect unauthorized access to your account.
• Not share your account with another person.

Bookiora is not responsible for losses arising from your failure to protect your account credentials.

4. Customer Responsibilities

Customers are responsible for reviewing all experience information before making a booking.

By booking an experience, customers agree to:

• Provide accurate booking information.
• Arrive on time for the booked experience.
• Comply with reasonable instructions provided by the host.
• Respect the host, venue, staff, and other participants.
• Pay any remaining balance due to the host where applicable.

Customers remain responsible for ensuring that they are physically and legally able to participate in the booked experience.

5. Host Responsibilities

Hosts are responsible for the experiences they publish and deliver through Bookiora.

Hosts agree to:

• Provide accurate titles, descriptions, pricing, schedules, and locations.
• Maintain accurate availability and booking capacity.
• Deliver experiences professionally and safely.
• Comply with all applicable laws and regulations.
• Provide customers with the services advertised.
• Maintain any licences or permits required to operate their experiences.

Hosts are solely responsible for the quality, safety, legality, and delivery of their experiences.

Bookiora reserves the right to suspend or remove any experience listing that violates these Terms or applicable laws.

6. Experience Listings

Hosts may create experience listings using the tools provided by the Platform.

All newly created or updated experiences are subject to review by Bookiora before becoming publicly available.

Bookiora may approve, reject, suspend, or remove any listing that:

• Contains misleading or inaccurate information.
• Violates applicable laws.
• Infringes intellectual property rights.
• Creates safety concerns.
• Violates these Terms & Conditions.

Approval of an experience does not constitute a guarantee or endorsement by Bookiora.

7. Listing Fees

Certain experience types may require hosts to pay a listing fee before the experience can be published on the Platform.

The applicable listing fee, where required, will be clearly displayed before payment is made.

Listing fees are non-refundable once the associated experience has been approved by Bookiora.

If a host changes an approved experience from a type that does not require a listing fee to one that does, the applicable listing fee must be paid before the updated experience can be published.

Bookiora reserves the right to revise listing fees from time to time. Any changes will apply only to future listings or updates requiring a new payment.

8. Bookings & Payments

Customers may book experiences using the payment options made available for each experience.

Depending on the experience, customers may:

• Pay the full experience amount online through Bookiora.
• Pay only the Booking Fee online and the remaining balance directly to the host at the venue.

All payments processed through Bookiora are securely handled using our authorized payment provider.

Customers are responsible for reviewing all payment information before confirming their booking.

9. Platform Fees

Bookiora may charge booking fees, listing fees, platform commissions, or other service fees in connection with the use of the Platform.

Any applicable fees will be clearly disclosed before payment is completed.

Bookiora reserves the right to update its fee structure at any time. Changes will not affect bookings or payments that have already been completed.

10. QR Passes & Check-In

Bookiora generates a unique QR Pass for each confirmed booking.

QR Passes are intended solely for verifying entry to the booked experience.

Customers must present a valid QR Pass where required by the host.

A booking may be considered redeemed once its QR Pass has been successfully verified through the Bookiora Platform.

Customers must not:

• Duplicate QR Passes.
• Modify QR Passes.
• Share QR Passes for unauthorised use.
• Attempt to bypass QR verification systems.

Bookiora reserves the right to invalidate any QR Pass that has been tampered with, duplicated, or fraudulently used.

11. Intellectual Property

The Bookiora Platform, including its website, software, logos, trademarks, branding, text, graphics, designs, and other content, is owned by or licensed to Bookiora and is protected by applicable intellectual property laws.

Except where expressly permitted, users may not:

• Copy or reproduce Platform content.
• Modify or distribute Platform materials.
• Reverse engineer any part of the Platform.
• Use Bookiora branding without prior written permission.
• Use Platform content for commercial purposes without authorization.

12. Host Content

Hosts retain ownership of the photographs, descriptions, titles, logos, and other content they upload to the Platform.

By submitting content to Bookiora, hosts grant Bookiora a non-exclusive, worldwide, royalty-free licence to store, display, reproduce, and distribute that content solely for the purpose of operating, maintaining, and providing the Platform.

Bookiora will not sell, licence, or otherwise commercially exploit host content outside the operation of the Platform without the host's permission.

Hosts are solely responsible for ensuring that they own or have the necessary rights to upload the content they provide.

13. Prohibited Activities

Users must use the Platform lawfully and responsibly.

You agree not to:

• Create false or misleading bookings.
• Create multiple accounts for fraudulent purposes.
• Share or misuse another person's account.
• Duplicate, alter, or fraudulently use QR Passes.
• Upload false, misleading, illegal, or offensive content.
• Interfere with the operation or security of the Platform.
• Attempt to gain unauthorised access to any part of the Platform.
• Reverse engineer, scrape, or copy Platform data without permission.
• Harass, threaten, or abuse other users, hosts, or Bookiora staff.
• Use the Platform for any unlawful or fraudulent activity.

14. Suspension & Termination

Bookiora reserves the right to suspend, restrict, or permanently terminate any account that violates these Terms & Conditions or applicable laws.

Reasons for suspension or termination may include, but are not limited to:

• Fraud or attempted fraud.
• Payment abuse or chargeback fraud.
• Repeated policy violations.
• Uploading prohibited or illegal content.
• Misuse of QR Passes.
• Activity that may harm Bookiora, hosts, customers, or other users.

Where appropriate, Bookiora may provide notice before taking action. However, immediate suspension may occur where necessary to protect the Platform or its users.

15. Platform Availability

We strive to keep Bookiora available and operating reliably.

However, the Platform may occasionally become unavailable due to:

• Scheduled maintenance.
• Software updates.
• Technical issues.
• Security incidents.
• Events beyond our reasonable control.

Bookiora does not guarantee uninterrupted or error-free operation of the Platform.

16. Limitation of Liability

Bookiora provides the technology platform that enables customers and hosts to connect and complete bookings.

Unless otherwise required by applicable law, Bookiora is not responsible for:

• The quality, safety, legality, or delivery of experiences provided by hosts.
• Errors or inaccuracies in information supplied by hosts.
• Disputes arising from payments made directly between customers and hosts.
• Losses resulting from misuse of user accounts or QR Passes.
• Indirect, incidental, or consequential damages arising from use of the Platform.

Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.

17. Indemnification

You agree to indemnify and hold harmless Bookiora, its owners, employees, and affiliates from any claims, losses, liabilities, damages, or expenses arising from your use of the Platform, your violation of these Terms & Conditions, or your infringement of any rights of another person.

18. Related Policies

Your use of Bookiora is also governed by our:

• Privacy Policy.
• Cancellation & Refund Policy.

These policies form part of these Terms & Conditions and should be read together.

19. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of Sri Lanka.

20. Changes to These Terms

Bookiora may revise these Terms & Conditions from time to time to reflect changes in our services, business practices, or legal requirements.

The updated version will become effective when published on this page. The "Effective Date" date will also be revised.

Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms & Conditions.
